Delivering reliable marine technology and service with integrity.

By accepting a quote, requesting or booking a service, making payment, or authorising us to access or work on a vessel, you agree to these Terms.

1. Our Services

 

Hull Tech Marine provides robotic underwater hull cleaning, underwater inspection, biofouling management, propeller and underwater component cleaning, fleet services and related marine technology services.

The precise scope of each service will be described in the applicable quote, booking confirmation, proposal or service agreement.

Our inspections are visual and operational assessments only unless expressly stated otherwise. They are not marine surveys, engineering inspections, classification inspections or structural certifications and should not be relied upon as a substitute for professional marine surveying or engineering advice.

We do not guarantee that any cleaning or inspection service will identify every defect, remove every form of fouling, or achieve a specific level of fuel saving, speed improvement or vessel performance.

2. Pre-Service Assessment and Right to Refuse Service

We may inspect the vessel and its underwater surfaces before commencing cleaning or other underwater work.

Hull Tech Marine may refuse, postpone, modify or stop a service where we reasonably believe that the work cannot be performed safely, effectively or in accordance with applicable marina, environmental or biosecurity requirements.

This may include circumstances involving excessive or unsuitable fouling, suspected marine pests or invasive species, unsafe weather or water conditions, poor visibility, damaged coatings, loose fittings, structural deterioration, underwater hazards or other conditions that may create unacceptable risk.

Where a service cannot proceed after attendance or inspection, a reasonable inspection or call-out charge may apply where this has been disclosed in the quote or booking conditions.

 

3. Vessel Condition and Client Disclosure

You must provide accurate information about the vessel, its location and its condition before the service.

You must advise us of any known underwater damage, recently applied coatings, deteriorated antifouling, previous repairs, osmosis, blistering, corrosion, loose fittings or other relevant conditions.

You should also identify any sensitive underwater equipment, including transducers, sensors, underwater lights, anodes, hydrofoils, trim tabs, thrusters, propellers, shafts and aftermarket equipment.

Hull Tech Marine is not responsible for pre-existing defects, deterioration or damage that existed before our service or which could not reasonably have been identified before work commenced.

 

4. Antifouling and Marine Coatings

Hull Tech Marine uses equipment and cleaning techniques intended to minimise unnecessary impact on marine coatings.

However, antifouling systems and other underwater coatings vary according to their age, condition, preparation, application and manufacturer specifications.

Normal wear, coating deterioration, flaking or degradation may become visible during cleaning, particularly where a coating is already deteriorated or approaching the end of its service life.

We may stop cleaning any area where we reasonably consider that continuing could cause unnecessary damage to the coating or vessel.

Nothing in this clause limits any rights or remedies that cannot lawfully be excluded.

5. Biofouling and Environmental Requirements

Hull Tech Marine aims to conduct its operations responsibly and in accordance with applicable marina rules,

regional requirements, environmental controls and marine biosecurity requirements.

In-water cleaning may not be suitable or permitted in all circumstances.

Where the nature or extent of biofouling, presence of suspected marine pests, vessel condition or applicable regulations make in-water cleaning inappropriate, we may decline the service and recommend alternative treatment or haul-out.

Hull Tech Marine does not guarantee that a vessel will meet every regulatory, marina or biosecurity requirement following a service. Responsibility for the vessel’s overall regulatory compliance remains with the vessel owner or operator.

 

6. Client Responsibilities and Access

The Client must ensure continuos access to a suitable 230 V AC, 50 Hz mains power supply at or near the berth for the duration of the service, together with safe and unobstructed access to the vessel.

7. Bookings, Cancellations and Weather

A booking is confirmed when Hull Tech Marine confirms it in writing, by email or through our booking system.

Service dates remain subject to weather, tides, water quality, visibility, marina access, operational conditions and safety considerations.

We may postpone or reschedule a service where conditions make the work unsafe or unsuitable. We will make reasonable efforts to provide a replacement service date.

If you need to cancel or reschedule, please provide at least 48 hours’ notice where reasonably possible.

Late cancellations, unavailable vessels or failure to provide agreed access may result in a reasonable call-out or cancellation charge where that charge has been disclosed beforehand.

8. Quotes, Pricing and Payment

Quotes are based on the information available to us at the time and may be subject to inspection of the vessel.

Unless expressly stated otherwise, quoted prices are exclusive of GST.

Additional work outside the agreed scope will only be undertaken where reasonably necessary or after discussing the additional work and charges with the Client.

Unless different payment terms are stated in the quote or invoice, invoices are payable within 14 days of the invoice date.

Hull Tech Marine may require a deposit or advance payment before commencing certain services.

We may suspend further services while an account remains overdue.

Reasonable debt recovery costs may be charged to the Client where permitted by law and where those costs are actually incurred.

 

9. Recurring Maintenance Services

Where a Client participates in a recurring hull maintenance or fleet programme, the frequency and scope of service will be stated in the applicable proposal or service agreement.

Service intervals may need to be adjusted because of vessel usage, water temperature, seasonal conditions, fouling growth, marina conditions or other operational factors.

Hull Tech Marine does not guarantee that a particular cleaning interval will prevent all biofouling.

 

10. Reports, Images, Video and Data

Hull Tech Marine may collect photographs, underwater video, inspection footage, equipment data and service information in connection with the work.

This information may be used to perform the service, prepare reports, maintain service records, diagnose equipment, improve our operations and comply with legitimate legal or regulatory requirements.

Where information identifies an individual, we will handle that information in accordance with applicable New Zealand privacy law.

We will not use identifiable images of your vessel for advertising or promotional purposes without your permission.

We may use anonymised operational or environmental information for internal analysis, technology development and service improvement where the information does not reasonably identify the Client or vessel.

A separate Privacy Policy may provide further information about how personal information is collected, used, stored and disclosed.

New Zealand’s Privacy Act governs how organisations collect, store, use and disclose personal information. 

11. Service Reports and Inspection Findings

Where included in the service, Hull Tech Marine may provide photographs, video footage, observations or a service report showing the apparent underwater condition of the vessel at the time of inspection.

Reports record conditions that were reasonably visible at that time.

They do not guarantee the absence of hidden defects and do not constitute a seaworthiness certificate, structural assessment, valuation, marine survey or engineering report.

Where we identify something that may require specialist assessment, we may recommend that the Client consult an appropriately qualified marine professional.

 

12. Third-Party Services

Hull Tech Marine may occasionally provide details of marinas, boatyards, surveyors, contractors, equipment suppliers or other marine service providers.

Unless expressly agreed otherwise, those providers operate independently from Hull Tech Marine.

Any contract for third-party services is between the Client and that provider, and Hull Tech Marine is not responsible for their services, pricing, availability or performance.

 

13. Liability

 

Hull Tech Marine will perform its services with reasonable care and skill.

Nothing in these Terms excludes or limits any right, guarantee or remedy that cannot legally be excluded or limited under New Zealand law.

For Clients acquiring our services as consumers, rights available under the Consumer Guarantees Act 1993 and other applicable consumer laws continue to apply.

Where the Client acquires the services in trade, and Hull Tech Marine and the Client are both in trade, the parties agree that, to the extent permitted by section 43 of the Consumer Guarantees Act 1993 and where it is fair and reasonable to do so, the Consumer Guarantees Act will not apply to the transaction. 

For business Clients, and to the maximum extent permitted by law, Hull Tech Marine will not be liable for indirect or consequential loss including loss of profit, loss of charter income, loss of business opportunity, demurrage or loss arising solely from vessel downtime.

To the maximum extent permitted by law, our liability relating to a particular service will be limited to the amount paid for that service, except where such limitation is prohibited by law.

The Client must notify Hull Tech Marine of any concern or alleged damage as soon as reasonably practicable after discovering it so that we have a reasonable opportunity to inspect and investigate the matter.

 

14. Events Outside Our Control

Hull Tech Marine will not be responsible for delay or failure to perform a service where this is caused by circumstances reasonably outside our control, including severe weather, unsafe sea conditions, marina restrictions, biosecurity restrictions, equipment failure despite reasonable maintenance, emergency events, port restrictions or government requirements.

Where possible, we will reschedule the affected service.

 

15. Changes to These Terms

 

Hull Tech Marine may update these Terms from time to time.

The Terms applicable to a particular service will normally be those provided or published when the service was booked or accepted unless otherwise agreed.

 

16. Governing Law

These Terms and all services provided by Hull Tech Marine are governed by the laws of New Zealand.

Any dispute arising from these Terms or our services will be subject to the jurisdiction of the New Zealand courts and tribunals.
